Terms of service

1. Subject

These Terms of Service govern use of the Artificiale.app website and of the custom business software development service offered by Roberto Cinque. By accessing the site or using the service, you accept these terms in full.

2. The service

The service consists of developing custom business software, preceded by a free review of the file the business already uses (typically one or more spreadsheets).

It runs in these stages:

• You send your file, or describe what you manage, via WhatsApp or by email (details are on /contatti).
• Roberto Cinque reviews the material free of charge and explains what it could become as custom software.
• If there is interest, a written quote is issued with scope, timing and cost.
• Once the quote is accepted, development begins.

The free review is a preliminary, non-binding service. Scope, timing, cost, delivery and support conditions are agreed case by case in the written quote, which prevails over these site terms. The site publishes no pricelists and no predefined offers: nothing on the site constitutes a contractual offer under Article 1326 of the Italian Civil Code.

3. Contact requests

The site has no contact forms: the only way to get in touch is the WhatsApp number or the email address shown on /contatti. Information you volunteer in that conversation is used solely to reply and to prepare the review. Sending a message does not create a contract or a commitment to buy for either side.

You warrant that the details you provide are correct and that you are entitled to share the files you send. Data is processed as described in the Privacy Policy.

4. Site and blog content

Content published on the site, including the blog, is informational. It:

• is indicative and not binding;
• does not constitute professional, legal, tax, accounting or financial advice;
• does not replace the opinion of a qualified professional;
• may contain rough estimates or assessments that change over time.

Any operational or investment decision based on the site's content is your responsibility alone.

5. Intellectual property

All content on the site (text, graphics, code, layout, trademarks) belongs to Roberto Cinque or to the respective owners and is protected by applicable copyright and industrial property law. Reproduction, modification or distribution without written permission is prohibited. Ownership of software developed to order is governed by the individual quote or contract.

6. Limitation of liability

The site and its content are provided “as is”. To the extent permitted by law, Roberto Cinque is not liable for direct, indirect, incidental or consequential damages arising from use of, or inability to use, the site or its content.

Nothing in these terms excludes or limits liability for wilful misconduct, gross negligence or any other liability that cannot be excluded by law.

7. Governing law and jurisdiction

These terms are governed by Italian law. For any dispute arising out of or connected with use of the site and the services, the courts of Naples, Italy have exclusive jurisdiction, save for any mandatory forum provided in favour of consumers.

8. Changes to these terms

Roberto Cinque reserves the right to change these Terms of Service at any time. Changes will be published on this page together with the date of the update. Continued use of the site after publication constitutes acceptance of the new terms.

9. Controller details

• Accept analytics and advertising cookies, with the “Accept analytics” button: this enables PostHog, Google Ads and the ChatGPT Ads pixel
• Reject everything that is not technical, with the “Necessary only” button: no cookie beyond the technical ones, and no advertising conversion measurement at all, not even the cookie-free server-side one described under C
